1. Subject matter of the contract
1.1 We, MaitriBodh Parivaar (International) GmbH, P.O. Box, 8404 Winterthur, Switzerland (hereinafter referred to as MBP), organise events, conduct seminars and consultancy services and handle administrative services.
1.2 Your registration constitutes a contract between you and MBP.
1.3 The following provisions apply to participation in all events.
2. Registration
2.1 Registration for MBP events takes place via an online booking system. After completing the online registration including payment of the course fee, you will receive an automatic confirmation by e-mail that your registration has been received. Your registration becomes binding when you receive the registration confirmation.
2.2 Registration for MBP events in Europe which include an overnight stay (e.g. BODH series, retreat, darshan etc.) is done via an online booking system. Registration for MBP events that do not include an overnight stay is also done via an online booking system. By completing the online registration, you conclude a contract for participation in the event. A contract for participation is concluded when you book your registration.
2.3 Registration for events in India is also made via an online booking system. In this case, MBP is not the organiser, but makes itself available as an administrative processor and acts only on behalf of the Indian client with whom the respective contract is concluded. All actions taken by MBP in these cases are only on behalf of the Indian client. After completion of the online registration and payment of the participation fee, you will receive an automatic email confirmation that your registration has been bindingly booked.
2.4 Guests certify that all information provided at registration are facts are true to the best of my knowledge and admission to the event with any discrepancy in the above information is subject to the discretion of the MBP AE team.
3. Terms of payment
3.1 Payment of the participation fee must be made immediately via an online booking system. As long as the participation fee has not been paid in full, MBP or the Indian client is not obliged to grant you access to the Event.
3.2 After conclusion of the contract for events organised by MBP in Europe or events organised by the Indian client in India, for which MBP only acts as an administrative agent, you can also transfer the participation fee via an online booking system.
4. Changes to the event
4.1 We reserve the right to make changes to the content, duration, location, date and time of the event, including changes to the speakers.
4.2 If the event is cancelled for reasons for which we are responsible, no participation fee needs to be paid. If the participation fees have already been paid, they will be refunded in the event of cancellation.
4.3 What we are responsible for shall be governed by Clause 7 of these Conditions of Participation.
4.4 Should the event not be able to take place on the scheduled date and/or location for reasons for which we are not responsible, we reserve the right to reschedule the event to another date and/or location of our choice. In this case, you are then entitled to withdraw from the contract if the rescheduling is not possible for you with regard to the date and/or location.
4.5 Should it not be possible to attend the event at a location for various reasons (e.g. temporary suspension of the event due to an official measure under the Epidemics Act), MBP offers the possibility of attending the event in the form of an online format or meetings. As not every event is suitable as an online course because personal attendance may be necessary, this option will be offered for the event suitable for it in each case.
5. Cancellation
5.1 A minimum number of 6 participants shall apply to MBP's open seminars. If the minimum number of participants is not reached, MBP will cancel the event without any claim for compensation on the part of the participant and refund the participation fee.
5.2 Cancellation of registration for MBP events in Europe (e.g. Bodh, Retreat, Darshan, etc.) is possible under the following conditions, unless otherwise specified in the announcement:

Up to 12 weeks before the start of the event free of charge

Up to 6 weeks before the start of the event, 50% of the participation fee will be refunded.

From 6 weeks before the start of the event, the full amount must be paid. i.e. no refund
- Cancellation must be made in writing to MBP, P.O. Box, 8404 Winterthur, Switzerland by e-mail to "info@maitribodh.eu".
5.4 Should an event not take place for reasons beyond the organiser's control (force majeure), the organiser reserves the right to reschedule the event to a date and/or location of its choice.
5.5 In the event of cancellation by MBP, MBP shall not be liable for the participant's travel expenses, accommodation costs or lost earnings. A participant's claims for compensation shall be limited solely to the participation fee.
6. Consent to the use of visual material and the making of visual and sound recordings
6.1 During the events, we will produce or have produced photographic material in order to use it for the purposes of documentation, for accompanying or subsequent reporting and for post-event advertising as well as for the commercial announcement of subsequent events. This may also include photographic material in which you are depicted.
If you are photographed in this context, we shall ensure that your personal rights are not unreasonably impaired in the use of the photographic material.
6.2 By concluding the contract for participation in the event, you give us your consent to the production and use of the photographic material in accordance with the above clause.
6.3 In order to protect the privacy of participants, the production and use of sound, image and film recordings is only permitted with the prior, express written consent of MBP. For information on the approval of sound, image and film material, please contact us at "info@maitribodh.eu".
7. Liability
7.1 We accept no liability for the event not taking place, unless we are responsible for this. In particular, we shall not be liable for the refusal of necessary official permits, for police and/or official or other requirements imposed by third parties during or in connection with the event, for infringements of the rights of participants and for the cancellation or termination of the event, unless we are responsible for this intentionally or through gross negligence.
7.2 In the event of simple negligence, we shall only be liable for breaches of material contractual obligations (cardinal obligations), i.e. obligations that enable the proper performance of the contract and on whose compliance the contractual partner may regularly rely. In this case, the scope of liability is limited to the typically occurring, foreseeable damage. There shall be no liability for indirect damage, defects, consequential damage or loss of profit. The limitation of liability shall also apply in the event of fault on the part of a legal representative or vicarious agent of ours.
7.3 Furthermore, our pre-contractual, contractual and non-contractual liability is limited to intent and gross negligence. However, in the event of gross negligence on the part of a simple vicarious agent of ours, the damage to be compensated shall be limited to the typically occurring, foreseeable damage.
The limitation of liability for gross negligence on the part of a simple vicarious agent shall not apply, however, if the damage is based on a breach of material contractual obligations (cardinal obligations).
7.4 The limitations of liability shall not apply in the event of injury to life, body or health of a human being and for liability under the Product Liability Act.
8. Copyright
By signing the participation in MBP events, I accept that the shared content and processes are the intellectual property of MBP and are subject to copyright.
9. Final provisions
9.1 All claims arising out of or in connection with this contractual relationship shall be governed by Swiss law to the exclusion of the provisions of the United Nations Convention and Contracts for the International Sales of Goods (CISG), the so-called "law of sales".
9.2 The District Court of Winterthur, Switzerland shall be the exclusive place of jurisdiction for all disputes arising from or in connection with contracts concluded with us.
9.3 Should one or more provisions of these Terms and Conditions of Participation be or become invalid, this shall not affect the validity of the remaining provisions.
